Mediation is mandatory in workers’ compensation. Cases subject to mediation must be mediated prior to a hearing being set. These claims include, but are not limited to: permanent and total disability; Third-party lien issues; occupational diseases; contested death claims; mental/mental injuries; and cases with concurrent jurisdiction under the South Carolina Workers’ Compensation Act, and the Federal Longshore and Harbor Workers’ Compensation Act. Collins & Lacy workers’ compensation attorney, Ellen Adams, was the first female from South Carolina to be selected for membership into the National Academy of Distinguished Neutrals (NADN), America’s largest professional association of top-tier neutrals. NADN is an invitation-only association whose members have been “thoroughly reviewed and found to meet stringent practice criteria and are among the most in-demand neutrals in their respective states.”
Mediation is also required by Supreme Court mandate for Common Pleas cases in almost every county in South Carolina and in other counties where any Circuit Court judge may order mediation.
