Collins & Lacy will provide a Continuing Legal Education (CLE) presentation to the Association of Corporate Counsel (ACC), covering a variety of topics relevant to the daily challenges faced by in-house counsel. The presentation, which offers three hours of CLE credit, will be held Friday, June 14, 2013 at The Palmetto Club of Columbia from 9 a.m. to 12 p.m., followed by a catered lunch.

This segment will discuss professionalism and ethical issues relating to mediation of a case, including the role of the mediator, in-house counsel and client expectations, presence/absence of decision-makers, and effective preparation and presentation of the client’s position. (This presentation will qualify for one hour of ethics credit).

10:15 – 10:45am – “How Did You Arrive at that Number? Factors to Consider in Case Evaluation” (0.5)

This segment will focus on various measurable and quantifiable strategies for case evaluation and management. It will survey various quantitative methods for evaluating exposure. In short, this presentation is designed to assist in-house counsel with determining whether outside counsel is “pulling a number out of thin air,” or if there is a definite method to their case evaluation.

This segment will survey the latest developments in the South Carolina General Assembly during the 2013 legislative session, including agenda items and laws affecting South Carolina businesses and their legal departments.
11:30 – 12 Noon – “I Liked It When I Signed It, But I Don’t Like It Now – It Must Be Unconscionable” (0.5)

This segment will focus on recent decisions of the South Carolina Supreme Court addressing challenges to contract provisions on the basis they are unconscionable.
12pm – 12:30pm – “The Proactive Approach to Workers’ Compensation Claims” (0.5)
Presented by: Kristian Cross
This segment will focus on avoiding surprises involving compensation coverage and keeping expenses down in litigation. With regard to avoiding surprises, speakers will address understanding liability for subcontractors’ employees, protecting companies from exposure for payment of benefits to employees of subcontractors, and understanding your “trade, business or occupation.” With regard to minimizing expenses, speakers will address “return to work” programs, “staying in contact with the injured worker” programs, and training programs for management on initial handling of claims when they are reported.
